Расскажу тебе про справедливый суд
Let me tell you about a fair trial.
Короче, как дело было
So, here's how it went down.
Точка торчал, это все с Заводского района знали
Tochka was a drug addict, everyone in the Factory District knew that.
И условный у него был, и сидел за торч
He had a suspended sentence, and he'd already served time for drug use.
А потом переломался и соскочил
But then he broke the habit and quit.
Ну, кто говорил, через анонимных
Some said it was through Anonymous,
Кто - через секту какую-то якобы
Others said it was through some kind of sect.
В общем, куда-то уехал на два месяца
Anyway, he went away for two months.
А вернулся - не узнать
And when he came back, you wouldn't recognize him.
Лицо розовое, голос добрый, и не торчит
His face was rosy, his voice was kind, and he wasn't using drugs anymore.


И кто его на радио пригласил?
And who invited him to the radio?
А это был 2008 год
It was 2008.
У нас на городском радио передача
We had a show on the city radio station
Про борьбу с наркотиками
About the fight against drugs.
И позвали Точку как положительный пример
And they invited Tochka as a positive example.
И спрашивают: «Сергей!

Как побороть наркотики в нашем городе?»

А Точка в ответ: «Не знаю!
And Tochka replied: "I don't know!
Но с наркоторговлей у нас никто и не борется

Был на Заводском районе Дрюня
There was a guy named Dryunya in the Factory District.
Они с Точкой в один класс ходили
He and Tochka went to the same class.
В одном доме жили
They lived in the same building.
С детства друг друга знали
They'd known each other since childhood.
Дрюня тоже торчал
Dryunya was also a drug addict.
Да у нас легче было сказать, кто не торчал
It was easier to say who wasn't an addict back then.
Такое было время
That's how things were.
И вот через неделю после той передачи
And a week after that radio show,
Дрюня звонит Точке и плачет
Dryunya calls Tochka and cries:
«Серёж, а Серёж
"Sergey, oh Sergey,
Очень болею, помоги взять!»
I'm in so much pain, help me get some!"
«Дрюнь, ну, как я тебе помогу?»
"Dryunya, how can I help you?"
«Серёж, а Серёж
"Sergey, oh Sergey,
Ну, ты ж барыг знаешь всех
You know all the dealers,
Я тебе денег дам, ты возьми мне, а?»
I'll give you money, you get some for me, okay?"
«Дрюнь, а сам что?»
"Dryunya, why don't you do it yourself?"
«Да ни у кого нет, кого я знаю
"Nobody I know has any.
А ты цыганей знаешь, и с Центра пацанов
But you know the Gypsies, and the guys from the city center.
Помоги, Серёж!»
Help me, Sergey!" And he persuaded Tochka.

Tochka took two thousand rubles
И уломал он Точку
And went to get the drugs.
Взял Точка две тысячи рублей
And here's the interesting part:
И поехал за чеком
He didn't get anything.
И вот тут интересное
Nobody had anything.
Ничего он не взял
And Dryunya was supposed to be waiting for him in the square near the market.

А Дрюня его должен ждать в сквере у рынка
Tochka gets off the tram,

Walks ten meters,

And suddenly, two plainclothes officers grab him by both arms
Проходит десять метров
And drag him around the corner where their car is parked.
И раз - его под обе руки берут оперативники
They search him and find two thousand rubles.
И тащат за угол, где у них тачка стоит
"Where are the drugs, you bastard?"
И обыскивают, находят две тысячи рублей
Tochka is confident:
«Где наркота, сука?»
"What drugs? I don't have anything!"
Точка в себе уверен
"We know you have drugs!"
«Какая наркота? У меня ничего нет!»
And they shove Tochka into the car.
«Мы знаем, у тебя наркота!»
They take him to the police station.
И заталкивают Точку в тачку
And there, four cops brutally beat him.
Везут его в отдел
And they plant drugs in his pocket.
И там его тупо пиздят четверо мусоров
And they say:
И заталкивают в карман вес
"So you've become a radio announcer for us, have you?
И приговаривают
You're hosting shows on the radio now?
«Ты диктором у нас заделался на радио, да?
Come on, come on, you'll be performing on the radio for us.
Ты у нас на радио теперь передачи ведёшь?
You'll be our announcer now."
Давай, давай, ты у нас повыступаешь на радио
And they take Tochka to the pre-trial detention center.
Ты у нас диктором теперь будешь»

И везут Точку в СИЗО
Tochka doesn't sign anything.

But the situation is this:
Точка ничего не подписывает
Dryunya is a witness for the prosecution.
Но тема такая
And at the trial, he gives testimony.
Дрюня - свидетель обвинения
Tochka, that is, Sergei Tochinkov,
И на суде даёт показания
28 years old, twice convicted,
Точка, то есть Сергей Точинков
Took two thousand rubles from him,
28 лет, дважды судимый
Promising to sell heroin.

And during the search, a mixture was found

Containing heroin - 2.6 grams,
При досмотре найдена смесь
A particularly large amount.

The prosecution asks for 8 years of imprisonment.
Особо крупный размер
The judge gives 6 years.
Прокуратура просит 8 лет лишения свободы

Судья даёт 6 лет
But Tochka doesn't give up.

And he gets a lawyer from Moscow.

And they file an appeal.
И у него появляется адвокат из Москвы
The lawyer meets with Dryunya.
И они подают апелляцию
And Dryunya cries: "I put my friend in jail!" And he says that he was arrested
Адвокат встречается с Дрюней
While under the influence of drugs
А Дрюня плачет: «Я друга посадил!»
And locked up for three days
И рассказывает, что его приняли
And on the third day he agreed to everything
В состоянии наркотического опьянения
That he would give the money to Tochka
И заперли на трое суток
And give testimony
И на третьи сутки он на всё согласился
But now his conscience is bothering him
Что деньги Точке даст
And at the second trial, Dryunya
И показания даст
Recants his testimony
А теперь его совесть мучает
And tells how everything really happened
И на втором суде Дрюня
But the court doesn't take him into account
От показаний своих отказывается
And Tochka goes to prison
И говорит как было всё

Но суд его во внимание не принимает
Yes
И Точка уезжает в колонию
The lawyer appeals to all the courts

Loses everywhere and files a complaint
Да
To the European Court of Human Rights
Адвокат подаёт во все суды
And after 6 years Tochka comes out of prison
Везде проигрывает и подаёт жалобу
With open form tuberculosis
В Европейский суд по правам человека
And dies six months later
А через 6 лет Точка приходит с зоны
And another six months later
С туберкулёзом в открытой форме
The European Court of Human Rights
И ещё через полгода умирает
Awards him 7,000 euros in compensation
А ещё через полгода
For violation of the right to a fair trial
Европейский суд по правам человека
That's how it all happened
Присуждает ему компенсацию 7 тысяч евро

За нарушение права на справедливый суд
And Dryunya continues to live in Zavodskoy
Вот так всё и было
Well, if he hasn't become a drug addict, of course

And hasn't gone to prison himself
А Дрюня дальше живёт на Заводском
And the money, by the way, all the money was paid out

Tochka's mother received it
И сам не сел
She was very grateful to the lawyer
